In operating the Service (as defined below), n, Inc. (“we”, “our” or “us”), headquartered at 20-21 Shinsen-chō, Shibuya-ku, Tokyo 150-0045 Japan (Representative Director: Koki Kumagai), explains in this Privacy Policy (“Policy”) how we handle Personal Information (as defined below) collected from individuals who use or intend to use the Service (collectively, “users”, “you” or “your”) and other data collected from users (collectively, “User Data” or “Your Data”). We comply with Japan’s Act on the Protection of Personal Information (“APPI”), all other applicable laws and regulations, and relevant guidelines issued by the Personal Information Protection Commission.

1. Definitions

  • “Personal Information” means the information defined in Article 2, Paragraph 1 of the APPI.
  • “Service” refers to the service currently called Fastnote that we provide (including any future version whose name or content changes).
  • Unless otherwise defined in this Policy, capitalized terms have the meanings given in the Fastnote Terms of Service (“Terms”).

2. Purposes for Collecting and Using User Data

2.1 Data We Collect

  1. Name or business name
  2. Address or registered head-office address
  3. Telephone number
  4. E-mail address
  5. Payment information
  6. Information related to inquiries
  7. Activity history within the Service
  8. Cookie IDs and other online identifiers, browser information, IP addresses, device details, and other usage data
  9. Any other information you voluntarily submit within the Service (including text entered for the purpose of obtaining answers from ChatGPT or other external machine-learning services)

2.2 How We Use Your Data

We collect and use Your Data (including Personal Information) for the following purposes. We guarantee that Your Data will not be used to train large-language models operated by OpenAI or any other external machine-learning provider.

  1. To verify your identity when providing the Service
  2. To send notices about new features or important updates of the Service
  3. To send information about our services (including services other than those you are already using) by email or other means
  4. To deal with the breach of the Terms or other Service rules
  5. To respond to inquiries about the Service
  6. To review activity history in order to operate or improve the Service and to develop new services
  7. To create and use statistical data that cannot identify any individual
  8. For purposes that are incidental to those listed above

2.3 Data from Third Parties

We may receive cookie-based or similar information (e.g., browsing history or interests) from advertising, research, or media partners. This information does not by itself identify you personally, nor link to your Personal Information we already hold, and will be used only for the purposes described above.

2.4 Changes to Purposes

We may change the purpose of use of User Data to the extent that the purpose of use after the change is reasonably recognized to be related to the original purpose of use. When the purpose of use has been changed, We shall notify users of the changed purpose of use, or publicly announce it after the change.

3. Proper Acquisition of User Data

  1. We shall acquire User Data by lawful and fair means. We shall not acquire User Data by deception or other wrongful means.
  2. Except when permitted by the APPI or other applicable laws and regulations, we do not acquire care-required personal information (defined in Paragraph 3 of Article 2 of the APPI) without your prior consent.
  3. When we receive Personal Information from a third party, we confirm the following matters pursuant to the rules of the Personal Information Protection Commission, except where exceptions provided for in the APPI apply.
    • The name and address of the third party and, if the third party is a corporation, the name of its representative
    • Background of the acquisition of Personal Information by the third party

4. Limits on Use

  1. We do not handle Your Data beyond the scope necessary for achieving the stated purposes without your consent; provided, however, that this provision shall not apply in the following cases:
    • cases based on laws and regulations;
    • cases in which there is a need to protect the life, wellbeing, or property of an individual, and it is difficult to obtain your consent;
    • cases in which there is a special need to improve public wellbeing or promote healthy child development, and it is difficult to obtain your consent;
    • cases in which there is a need to cooperate with a national government organ, local government, or person entrusted thereby with performing the functions prescribed by laws and regulations, and obtaining your consent is likely to interfere with the performance of those functions.
  2. We shall not utilize User Data in a way that there is a possibility of fomenting or inducing unlawful or unjust act.
  3. We will retain Your Data no longer than necessary for the purposes for which we collect Your Data.

5. Sharing with Third Parties

  1. We shall not provide your Personal Information to a third party without your prior consent, except where such provision falls under any of the Items of Paragraph 3 of Article 2. By using the Service, you acknowledge and agree that information you submit may be sent to ChatGPT or other external machine-learning services to obtain responses.
  2. In the following cases, a person receiving Personal Information is not to fall under a third party regarding applying the provisions of the preceding paragraph:
    1. Cases where we entrust a person with all or part of the handling of Personal Information within the scope necessary for achieving the purpose of use;
    2. Cases where Personal Information is provided when a person succeeds to the business due to a merger or other such circumstances;
    3. Cases where Personal Information is used jointly with others in accordance with the provisions of the APPI.
  3. Whenever we provide Personal Information to a third party, we prepare and keep records pursuant to Article 29 of the APPI.

6. Security Measures

We shall take necessary measures for managing the security of Personal Information against leaking, loss, or damage. If we entrust another person with all or part of the handling of Personal Information, we shall exercise the necessary and adequate supervision over the person it entrusts, so as to ensure the secure management of the personal data with whose handling it entrusts that person. For details of our measures (beyond those described in this Policy, such as compliance with applicable laws, regulations and guidelines, etc., and our establishment of a contact point for complaints and questions), please contact us in accordance with Article 11 below. If you contact us in this way, we will respond to you without undue delay.

7. Requests for Disclosure

If you request disclosure of your Personal Information under the APPI, we shall disclose your Personal Information without undue delay, except where there is no obligation to disclose under the APPI or other applicable laws or regulations. Please note that we will charge the fee (JPY 1,000 per disclosure) to you with the disclosure of your Personal Information.

8. Requests for Correction, Addition, or Deletion

If you request correction, addition, or deletion of your Personal Information on the ground that it is not factual, we will make a necessary investigation without delay within the scope necessary for the achievement of the purpose of use. When we have corrected, added, or deleted all or part of your Personal Information as requested or have decided not to make such correction, addition, or deletion, we shall notify you of that effect (including the content of the correction, addition, or deletion if performed) without delay. This Article shall not apply to cases in which we are not obliged to make such correction, addition, or deletion under the APPI or other laws or regulations.

9. Requests for Discontinuance of the Utilization, etc.

Where we are (i) requested to discontinue using or to erase your Personal Information under the APPI or (ii) requested to discontinue providing your Personal Information under the APPI, and where it is found that the request has a reason, we shall discontinue using or erase your Personal Information concerned or discontinue providing your Personal Information concerned without delay, and shall notify you of that effect. This Article shall not apply to cases in which we are not obliged to make such discontinuance of use or erase, or discontinuance of provision, under the APPI or other laws or regulations.

10. Cookies and Similar Technologies

We use cookies and similar technologies. You can disable cookies in your browser settings, but doing so may limit access to some features of the Service.
